HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15866 of 2014 ORDER:
Petitioners claim to have executed the contract pursuant to the agreement No.25/ENC/GHMC/TA-II/K5/2008, dated 03.11.2008. In terms of the said agreement, petitioners have undertaken construction of the houses along with providing infrastructure i.e., Housing Components under Basic Services for the Urban Poor (BSUP) under Jawaharlal Nehru Urban Renewal Mission (JNNURM). The said works were within the territorial limits of Greater Hyderabad Municipal Corporation (GHMC). The entire work was completed by the year 2011. As the work was completed and all formalities were completed long ago, petitioners have submitted claim for settlement of final bills and returning of Fixed Security Deposit (FSD), amount withheld for quality control report and amount deducted for labour cess. Since there was delay in settlement of final bills and above amounts and having waited for considerable time, periodically representations were submitted requesting settlement of final bills. Alleging that in ordinate delay in settlement of final bills, present writ petition is instituted.
2. During pendency of the writ petition, petitioner also submitted further representation on 21.02.2015 enclosing statement showing the amount which they are entitled to receive.
3. Learned counsel Sri B.Narayana Reddy for petitioners submits that so far no orders are passed on the said representation and so far the amounts due and payable to the petitioners are not settled.

Having regard to the fact that petitioners have submitted claims for settlement of final bills and other amounts in terms of the agreement dated 03.11.2008 and the said claims are pending consideration by the respondent corporation, without expressing any opinion on merits, writ petition is disposed of, directing the 2nd respondent to consider the claim submitted by the petitioners on 22.01.2015 with reference to the work undertaken by the petitioners under JNNURM scheme, take a decision and pass appropriate orders and communicate the same to the petitioners within a period of six weeks from the date of receipt of a copy of this Order. Miscellaneous petitions if any pending in the writ petition shall stand closed. There shall be no order as to costs.
