THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7198 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.39 of 2022 pending on the file of Bellampalli II Town Police Station, Mancherial District registered for the offence under Section 302 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that a complaint was lodged on 05.06.2022 stating that the complainant who is the son of the deceased went to the house and found his mother with stab injuries, immediately, she was shifted to the hospital where she was declared as brought dead. The petitioner who is the husband allegedly inflicted stab injuries with a knife over the chest of the deceased and fled.

Learned counsel for the petitioner submits that the petitioner was arrested on 06.06.2022 and the police during the course of investigation examined nearly twelve witnesses. 5.

In the said circumstances, the petitioner/Accused can granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Bellampalli, Mancherial District.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter shall appear as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
