THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36414 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed by the petitioners to direct the respondents 1 to 3 to initiate disciplinary action against respondents 4 and 5 for their serious misconduct committed against the 2nd petitioner, while on duty, by suspending them fro service and also to conduct investigation and file charge sheet against respondents 4 and 5 in FIR No.254 of 2015 on the file of 3rd respondent police station.

Heard and perused the material available on record. The main grievance of the petitioners is that though the case was registered in March 2015 on the basis of the complaint lodged by the 1st petitioner, the 4th respondent did not choose to conduct investigation and failed to take action against the respondents 4 and 5. Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, 3rd respondent is directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
