THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17738 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " .... to issue an appropriate writ order or direction more one in the nature of Writ of Mandamus declaring the action of the Respondent police especially the 4th respondent in calling and threatening the petitioners to stop the construction in Sy.No.409/A (Plot No.12) admeasuring 278.66 sq.yards and Sy.No.409/A (Plot No.13) admeasuring 191.50 sq. yards respectively situated at Mothe Shivar Jagityal Mandal, Jagityal District and settle the matter with the landgrabbers as arbitrary, illegal, unconstitutional apart from being violative of Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere into the petitioners' property and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.

The main grievance of the petitioners is that the respondents- police are oftenly calling the petitioners to the police station and threatening them to stop the construction works carried out by them in survey No.409/A at Mothe Shivar, Jagityal Mandal and District.

Learned AGP disputes the same and submits that any action by the respondents-Police would only be in accordance with law.

Having regard to the above, the Writ Petition is disposed of directing the respondents-Police to follow due process of law, if any action is sought to be initiated against the petitioners in respect of subject property.
