Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor representing the respondentState and perused the record. 2.
On 20.09.2014, this Court, while granting interim stay as prayed for, ordered the petitioner to serve personal notice on the unofficial respondents. No notice has been served so far.

This Transfer Criminal Petition is filed under Section 407 Cr.P.C. by the petitioner-complainant seeking to withdraw S.C. No.305 of 2013 from the file of the V Additional Sessions Judge, Khammam at Kothagudem and transfer the same to the file of the Principal Sessions Judge, Khammam. 4.
The aforesaid Sessions Case relates to murder of husband of the petitioner-complainant. It is alleged that the petitioner and other eye-witnesses are being threatened by the unofficial respondents-accused and hence, they apprehend danger to their lives if they visit Kothagudem to depose before the Court in the course of trial. But, no document is filed to substantiate the same. If there is any threat, nothing prevented the petitioner to lodge a report to police. There is nothing to show the same. However, in view of the apprehension expressed by her, protection can be given to her and the other eye-witnesses. Therefore, whenever the petitioner and other eye-witnesses visit the Court below to give evidence in the aforesaid Sessions Case, the Station House Officer, Kothagudem shall take all necessary measures to avoid any untoward incident in the Court premises as well
as outside and if required, provide necessary police protection.

With the above observation, the Transfer Criminal Petition is disposed of.
Miscellaneous Petitions pending, if any, in the Transfer Criminal Petition shall stand closed.
