Petitioners' grievance is that house sites have been allotted to them and the 4th respondent is trying to dispossess them without following due process of law.

Learned Government Pleader for Revenue appearing for respondents states that 4th respondent is proposing to issue notices to petitioners why petitioners' house site pattas granted to them shall not be cancelled. She assures that 4th respondent will serve notices on petitioners, considers petitioners' explanation to the show cause notices and then pass reasoned order and communicate it to the petitioners individually. She also stated that till such exercise is completed, petitioners will not be dispossessed from the subject land.

In view of the said submissions, the Writ Petition is disposed of directing the 4th respondent to follow due process of law by serving show cause notices on each of the petitioner giving time to them to file explanations, consider the explanation, if any, filed by them, pass reasoned orders and communicate them to the petitioners individually and till such exercise is completed, petitioners shall not be evicted from the subject land. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
