THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4095 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the order dated 3.11.2015 passed in Crl.M.P.No.305 of 2015 in C.C.No.333 of 2015 on the file of the I Metropolitan Magistrate, Hyderabad. Heard and perused the material available on record. The above Crl.M.P. was filed by the petitioner seeking to recall NBWs issued against the petitioner. The trial Court dismissed the said Crl.M.P. vide the order impugned herein. Hence, the petitioner approached this Court.

Considering the facts and circumstances of the case, the petitioner-A2 is directed to file a fresh application before the Court below seeking to recall NBWs issued against him. On such application being filed, the Court below is directed to recall NBWs issued against the petitioner on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety, for the like sum to the satisfaction of the Court below. The petitioner-A2 is directed to appear before the Court below regularly on all hearing dates.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
