Learned counsel for the petitioner is present. Learned Additional Public Prosecutor would represent that the concerned Investigating Officer has filed a report dated 13.09.2016 seeking permission of the Court to close the crime on the ground that there is "lack of evidence" and therefore, the present petition has become infructuous.

In view of the submission made by the learned Additional Public Prosecutor, the present Criminal Petition is dismissed as infructuous.

Consequently, Miscellaneous Petitions, if any, pending in this petition shall stand closed.
