THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.5369 of 2017 ORDER:

Heard Mr M. Radha Krishna for petitioners.

The defendants filed I.A.No.903 of 2017 in O.S.No.789 of 2011 under order XVI, Rule 6 and 7 of Code of Civil Procedure to summon witness and cause production of original house tax register dealing with the property No.51-980/163, corresponding new door No.51-980/189, water tap connection record etc.

The petition is dismissed by the trial Court through the order impugned in the Revision. This Court is of the view that petitioners herein at the first instance ought to have worked out the procedure prescribed by Rule 129 of Civil Rules of Practice and thereafter placed the copies of that record before the Court. I am in agreement with the findings recorded by the trial Court. No ground for interference is made out. Revision fails and dismissed.

Since Revision is dismissed by referring to the procedure available under Rule 129 of Civil Rules of Practice, this Court to avoid any confusion in appreciating the dismissal, clarifies that the petitioners if so advised can move the authority for grant of copies of documents and once the copies are made

available, the petitioners can take steps to bring them on record in accordance with law.

CRP is disposed of with above observation. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
