THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT APPEAL No. 1377 of 2016 JUDGMENT: (Per VRS,J) The writ appeal is directed against an interim order, which reads as follows:

"Any appointment made to the post of Assistant Engineer (Mechanical) in B.C.-E Women category would be subject to further orders in this writ petition."

Heard Mr. J. Sudheer, learned counsel for the appellant, and Mr. G. Vidya Sagar, learned senior counsel appearing for the 2nd respondent.

The main writ petition is with regard to the non-selection of the appellant to the post of Assistant Engineer (Mechanical). Therefore, the learned Judge thought fit to pass the interim order, as extracted above.

The main contentions of Mr. J. Sudheer, learned counsel for the appellant, is that the 1st respondent has already filed a counter claiming that since one candidate belonging to B.C.-E, who is the 2nd respondent herein, who could not have been selected in her own Zone,

has been wrongly brought to Zone-I, the appellant lost her opportunity, and that the matter could have been decided even finally, without making the writ petition kept pending for a long time. 5.

It is true that some matters require a consideration of limited nature and limited time, and some matters require a detailed consideration. But, at the time when writ petitions come up for orders as to admission, the perception of every individual Judge differs. At the stage of admission, perhaps the learned Judge thought that since there was a private respondent, the matter could not have been disposed of.

Therefore, we cannot interfere with the interim order passed by the learned Judge. Hence, the Writ Appeal is dismissed. However, the Registry may list the writ petition for final disposal, depending upon the convenience of the learned Judge and the learned Judge may endeavour to dispose of the writ petition within two (2) months. Consequently, miscellaneous petitions if any pending in the writ appeal shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G.
