HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6617 OF 2018 ORDER:

The petitioner is the sole accused in crime No.143 of 2018 of Yacharam Police Station, Rachakonda District, registered for the offences punishable under Sections 420, 376 & 493 IPC.

It was based on the report of the defacto complainant dated 08.05.2018 stating that the accused is her brother-inlaw by relation and both of them were working in Micromax company and he loved her and consequently he developed sexual intercourse with a promise to marry by putting sindoor on her face saying it is a valid marriage and under that pretence of legal marriage later even continued sexual intercourse and all of a sudden changed his mind saying he has not chosen to marry and preparing to marry another girl. He is in judicial custody since 10.05.2018.

Learned counsel for the petitioner produced additional material that he has disability to left lower limb described as 54% issued by the Medical Board under G.O.Ms.No.31, WD, CW and DW Department, dated 01.12.2009.

Even taking into consideration of all these from the factual matrix, the petitioner pending investigation does not deserve the concession of bail.

Accordingly and in the result, this Criminal Petition is dismissed.
