THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7077 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.2 in the event of his arrest in Crime No.845 of 2022 on the file of Station House Officer, Medipally Police Station, Rachakonda registered for the offences punishable under Sections 143, 144, 147, 148, 324 and 307 read with Section 149 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused No.2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the petitioner is alleged to have attacked the de facto complainant and others along with his family members who are Accused Nos.1, 3 to 5. In the altercation that ensued between the de facto complainant's family and family members of this petitioner, persons on both sides received injuries.

Learned counsel for the petitioner submits that the father of the petitioner filed a complaint which is registered as Crime No.846 of 2022 by the same police station. He further submits that the petitioner received injuries and treated in Kakatiya Hospital. 5.

As seen from the complaint there is no specific allegation against this petitioner. However the complaint states that all of them have attacked with stones and sticks; since both the cases arose out of one single altercation between two families and the petitioner receiving injuries and being treated in hospital, this Court feels it appropriate to grant Anticipatory Bail to this petitioner. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.2 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Medipally Police Station, Rachakonda within ten days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused No.2 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 11.08.2022 ns
