THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.21625 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Transport. When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue, in the present Writ Petition, is squarely covered by the order of this Court, reported in SHOUKAT HUSSAIN v.
DEPUTY TRNASPORT COMMISSIONER AND SECRETARY, REGIONAL TRANSPORT AUTHORITY, ADILABAD AND ANOTHER1. A copy of the said order is placed on record. The same is not disputed by the learned Government Pleader. In view of the law laid down, in the above referred judgment, and taking into consideration the submissions made by the learned counsel for the petitioner, there shall be a direction to the District Transport Officer, Regional Transport Authority, Karimnagar-second respondent herein to release the vehicle bearing No.AR 02-4199, subject to the petitioner depositing a sum of Rs.10,000/- (rupees ten thousand only) and subject to filing an undertaking that the petitioner herein will not alienate or in any manner transfer the ownership of the said vehicle, pending determination of the petitioner's liability. It is also made clear that the respondents are entitled to proceed in accordance with law. 1 2012 (5) ALT 609
Accordingly, Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
