M/S. Yona Smeleters Limited v. Commercial Tax Officer
THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.31393 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) Sri S. Dwarakanath, learned counsel for the petitioner would submit that, in compliance with the order passed by this Court in WPMP.No.40577 of 2015 on 28.09.2015, the petitioner paid Rs.16,89,500/-; and the subject matter of this writ petition is covered, against the assessee, by the judgment of the Division Bench of this Court in Ankamma Trading Co. v. Appellate Deputy Commissioner[1].
Sri S. Suri Babu, learned Special Standing Counsel for Commercial Taxes, expresses ignorance with regards the petitioner's claim to have paid Rs.16,89,500/-. It is wholly unnecessary for us to dwell on this aspect, as Sri S. Dwarakanath, learned counsel for the petitioner, would fairly state that the writ petitioner, as filed, is liable to be dismissed in view of the law declared by this Court in Ankamma Trading Co..
Following the judgment of the Division Bench, in Ankamma Trading Co.1, this writ petition is dismissed. Consequently, miscellaneous applications pending if any shall also stand dismissed. No costs.
