HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No. 22002 of 2013 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents 1 and 2. The prayer sought in the writ petition is as under: " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue a writ, order or direction more particularly in the nature of writ of mandamus seeking a direction to the respondents 1 and 2 to take immediate action against the 3rd respondent in accordance with law, pursuant to the complaint dated 22.07.2013, and to grant such other relief or reliefs as this Court may deems fit and proper in the circumstances of the case." The second respondent filed a counter affidavit stating that on verification of the station records, the complaint/ petition dated 22.7.2013 submitted by the petitioner herein, is not available and also no case was registered against third respondent, based on the said complaint. In view of the same, this Court cannot consider the request of the petitioner to direct the respondents 1 and 2 to take action on the said complaint.

In view of the same, this court is of the opinion that no cause would survive in the present writ petition.

Accordingly, the writ petition is dismissed. There shall be no order as to costs.
