THE HON'BLE SRI JUSTICE A.V.SESHA SAI CIVIL REVISION PETITION No.1314 of 2015 ORDER:
The grievance in the present Civil Revision Petition, filed under Article 227 of the Constitution of India, is non-disposal of the application filed by the petitioner herein, vide I.A.No.440 of 2014 in A.S.No.57 of 2014 on the file of the District Judge, Prakasam District at Ongole.
Heard the learned counsel for the petitioner. None appears for
the respondents, despite service of notice on them. The 1st respondent herein filed I.P.No.12 of 2006 on the file of the Senior Civil Judge, Parchur, Prakasam District. The learned Senior Civil Judge, Parchur decreed the said I.P.No.12 of 2006 on 02.06.2014, declaring the petitioner as insolvent. As against the said order dated 02.06.2014, the petitioner herein (1st respondent in I.P.No.12 of 2006) preferred A.S.No.57 of 2014 on the file of the District Judge, Prakasam District at Ongole, on 04.07.2014. In the said A.S.No.57 of 2014, the petitioner herein also filed I.A.No.440 of 2014, seeking stay of operation of the order and decretal order dated 02.06.2014 passed by the learned Senior Civil Judge, Parchur. In the above backdrop, the present Revision has been filed.
The petitioner herein is praying this Court for a direction to the Court below to dispose of the said I.A.No.440 of 2014 in A.S.No.57 of 2014. Taking into consideration the totality of circumstances and having regard to the nature of the case, this civil revision petition is disposed of, directing the Court of the District Judge, Pakasam District at Ongole, to dispose of I.A.No.440 of 2014 in A.S.No.57 of 2014, in accordance with law, within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending in this civil revision petition, shall stand closed.
