The above writ petition is filed seeking to issue writ of Mandamus declaring the action of respondent No.3 in suspending the petitioner from service on the allegation that he misplaced the case file of another Driver, as illegal and arbitrary.

When the matter came up for hearing, it is brought to the notice of this court that the petitioner has challenged the order under which he was suspended pending enquiry, and subsequently, the petitioner was reinstated and has been continuing in service. Hence, the cause in the writ petition does not survive.

However, in the facts and circumstances of the case, this court of is of the considered view that ends of justice would be met if the respondents are directed to treat the period from 28.08.2010 till 04.03.2011 as 'spent on duty' for all other purposes, as per the rules in vogue.

With the above directions, the writ petition is disposed of. No costs.

Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
