THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.2226 of 2012 ORDER:

Sri V.Surendra Reddy for petitioner, the Assistant Government Pleader for Home and Ms.N.Niyatha for respondents 5 and 6. Learned counsel for petitioner, after arguing the writ petition for sometime and having regard to the reply of 2nd respondent and the availability of material to contradict the stand taken in the counter affidavit, requests the Court to permit the petitioner to withdraw the writ petition with liberty to avail remedy before Magistrate Court in accordance with law.

He further submits that the respondents have already filed charge-sheet in the FIR registered against the petitioner and the same is subject matter of trial.

I have perused the material available on record and also the material on which the petitioner intends to rely upon before Magistrate court.

I am satisfied that the request of petitioner to withdraw the writ petition with liberty to approach Magistrate Court can be granted. Accordingly, the writ petition is dismissed as withdrawn by granting liberty as prayed for. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V.
