HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CONTEMPT CASE No.1507 OF 2018 ORDER :

This Contempt Case is filed alleging violation of orders passed by this Court in WP.No.1859 of 2017, dated 27-02-2017.

Learned Government Pleader for Revenue submits that in pursuance of the orders passed by this Court, the respondent has passed orders dated 21-03-2018 stating that the request of the petitioner for regularization of surplus land in plot No.10-B, Sy.Nos 572 and 548, Alwal Village, Malkajgiri Mandal cannot be considered since status-quo orders are existing in WA.No.1438 of 2009 and Batch on the above land. However, it is brought to the notice that WA.No.1438 of 2009 and batch stood disposed of. He also submits that subsequently, an endorsement dated 09-10-2019 has been issued by the respondent rejecting the request of the petitioner for regularization of above said land. But learned counsel for the petitioner tried to canvass the correctness of the said endorsement dated 09-10-2019 stating that applications of the similarly situated persons have been considered and disposed of.

It is to be seen that this Court cannot enlarge the scope in a contempt case and go into the correctness or otherwise of the order. When the applications of the similarly situated

persons have been considered and disposed of, it is open for the petitioner to challenge the said endorsement by placing necessary material before the Court.

In view of the same, the Contempt Case is closed granting liberty to the petitioner to challenge the endorsement dated 09-10-2019 in accordance with law. As a sequel, miscellaneous applications pending, if any, shall stand closed.
