This writ petition is filed for the following substantive relief: "...to issue appropriate writ, order or direction particularly in the nature of Writ of Certiorari calling for the records pertaining to setting aside the operation of the Labour Court -III order in I.D. No.14/2002, dt.10.12.04 and the consequential orders issued by the Labour, Employment Training & Factories (LAB.I) Department, vide G.O. Rt. No.784, dt.01.04.2005 and Lr.No.B/666/2005, dt.12.03.2007, and set aside the same by declaring them as arbitrary, illegal and violative of the principles of natural justice." At the hearing, there is no representation for the petitioner. A perusal of the proceedings sheet shows that this Court has permitted the counsel for the petitioner to take out notice to respondent No.

1 with a default clause that if such acknowledgement is not filed within two weeks, the writ petition shall stand dismissed qua respondent No.1 without further reference to the Court. The office report shows that the acknowledgement of notice has not been filed by the petitioner and that the order of dismissal against respondent No.1 has come into effect. Since the relief is claimed against respondent No.1 alone, respondent Nos.2 to 4 being proforma parties, with the dismissal of the writ petition for non-service of notice against respondent No.1, the cause in the writ petition does not survive.

The writ petition is therefore dismissed as infructuous. As a sequel to dismissal of the writ petition, interim order dt.13.8.2007 passed in W.P.M.P.
