THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24795 OF 2019 O R D E R :
The case of the petitioner is that its request for power connection in domestic category has not been considered by the respondent Authority, to the plot in Survey Nos. 175 and 176, admeasuring 605 square yards or 505.78 square meters situated at Suraram Village, Quthbullapur Mandal, though the Application was made as far back as on 31.01.2019 vide Registration No. NR907192693275.
Heard learned counsel for the petitioner.
Learned Standing Counsel for the respondents Sri R. Vinod Reddy, on instructions, submits that a complaint was made on behalf of one Mr. S. Chandra Sekhar, S/o Srinivas, claiming that the subject property was purchased by him under document No. 226/1969 and that the petitioner is trying to encroach on to the said property with the aid of the police. It is also further asserted that the said individual, through his power of attorney, had in fact, made an Application for providing electricity connection on 29.01.2019 by paying Rs.3,362/- vide DD No. 001191 and the same is pending. When the petitioner objected to the same, they had filed O.S. No. 107 of 2019 on the file of the Senior Civil Judge's Court at Medchal and an injunction order in I.A. No. 371 of 2019 also came to be granted on 13.03.2019.
Having regard to the facts which are brought on record and in the light of the civil dispute pending between the parties, the action of the respondents in not providing power connection to the petitioner, at this stage, cannot be found fault.
The Writ Petition is therefore, closed leaving it open to the petitioner to work out the remedies available to it under law. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
