THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21559 of 2004 ORDER:

This writ petition is filed seeking writ of Certiorari calling for the records from the 2nd respondent and quash the Award dated 28.11.2003 of the 2nd respondent in LCID No.97 of 2002, as illegal and arbitrary.

When the matter is taken up for hearing today, it is noticed that the writ petition against the first respondent-Workman was dismissed for default vide orders dated 30.12.2010 and the petitioner as well as the first respondent had not taken any steps to restore the writ petition against the first respondent-Workman. This writ petition is filed challenging the orders passed in LCID No.97 of 2002, dated 28.11.2003 passed in favour of the first respondent-Workman.

In view of the order dated 30.12.2010 dismissing the writ petition for default against the first respondent, in whose favour the Award had been passed, this Writ Petition cannot be adjudicated on merits.

Accordingly, the writ petition is dismissed.

Miscellaneous petitions pending if any, shall stand closed. No costs.
