THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.12817 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the 2nd respondent in rejecting the application of the petitioner for the post of Junior Lecturer, commerce in Government Junior Colleges, vide Memo No.Nil, dated 03.07.2004, in view of the notification No.3/2004, dated 04.03.2004 as illegal, arbitrary and violative of Articles, 14, 16 and 21 of the Constitution of India and consequently direct the respondents to permit the petitioner for written examination of junior lecturers, commerce in Government Colleges, scheduled to be held on 25.07.2004 and consider his candidature on par with the other candidates and to pass such other necessary orders. At the time of hearing, learned counsel for the petitioner submitted that the purpose of filing the writ petition becomes infructuous.

In view of the submission made by the learned counsel for the petitioner the writ petition is dismissed as infructuous. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
