THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5478 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner in C.C.No.121 of 2015 on the file of the Court of the I Additional Judicial Magistrate of I Class, Khammam. 2 The learned counsel for the petitioner seeks permission of the Court to permit the petitioner to withdraw the Criminal Petition, with liberty to avail the remedies available to him under law including filing of petition for discharge, if charges are not already framed. He further seeks the permission of this Court to permit the petitioner to file a petition under Section 205 Cr.P.C. before the trial Court. Permission is accorded.

3 In the result, this Criminal Petition is dismissed as withdrawn, granting the liberty as prayed for. In the event of the petitioner filing petition under Section 205 Cr.P.C, the trial Court is hereby directed to dispose of the same in accordance with law and taking into consideration the profession of the petitioner.
