HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24833 OF 2019 ORDER :

This Writ Petition is filed for the following relief: "....pleased to issue an appropriate writ, order or direction particularly one in the nature of writ of Mandamus, declaring the action of the 2nd respondent in refusing to give permission in Lr. No.2/C21/18737/2019, dated 31.10.2019 for proposals for construction of building, on Plot No.39 and 40, Sy.No.44/4, Maqta Mahaboobpet Village, Serilingampally Manal, Ranga Reddy District, for being illegal, arbitrary, violative of provisions of GHMC Act, discriminatory and unconstitutional and consequently direct the 2nd respondent to forthwith accept the application of the petitioners and grant permission for construction of building, on Plot Nos.39 and 40, Sy.No.44/4, Maqta Mahaboobpet Village, Serilingampally Mandal, Ranga Reddy District."

When the matter is taken up for hearing, it is submitted by the learned counsel for the petitioners as well as learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for respondent No.2 that the issue raised in the present Writ Petition is squarely covered by the common order dated 06.08.2019 passed by this Court in Writ Petition No.12013 of 2019 and batch.

3. Relevant portion of the aforesaid order reads as under: "Therefore, all the writ petition are disposed of directing the respondent Corporation to process the building permission applications submitted by the petitioners without insisting for securing NOCs from the Revenue Department, if basis of such mandate by the GHMC was on the ground that Survey No.44/4 of Maqta Mahaboobpet Village, Serilingampally Mandal, Ranga Reddy District, is included in the Gazette Publication of Ranga Reddy District, dated 26.09.2013. If there is any other objection for granting building permission, the same shall be informed to the petitioners. "

4. Following the aforesaid common order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof. Miscellaneous petitions, if any pending, in this writ petition also stand disposed of. There shall be no order as to costs. ___________________________ CHALLA KODANDA RAM, J November 12, 2019.
