HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9827 OF 2015 ORDER:

Petitioners filed this Writ Petition to declare the inaction of the respondent Nos.2 to 4 and their subordinates in protecting the "Gramakantam Land" in Sy.Nos.408-2, 408-3, 408-4, 409 and 413, total admeasuring Ac.25-00 cents, situated at Terripadu Revenue Village, Putheri Grampanchayat, B.N.Kandiga Mandal of Chittoor District, despite the representations submitted by the petitioners on 21.07.2014, 22.09.2014 and 24.11.2014 is ex-facie, illegal and arbitrary, and consequently direct the respondent Nos.2 to 4 to take immediate steps to protect the said land by way of fencing. It is the case of the petitioners that the land in an extent of Ac.25-00 cents situated in Sy.Nos.408-2, 408-3, 408-4, 409 and 413 of Terripadu Revenue Village, Putheri Grampanchayat, B.N.Kandiga Mandal of Chittoor District is a land recorded as Gramakantam land.

On earlier occasion basing on the complaints by the petitioners and others encroachments were removed. However, once again some antisocial elements are encroaching on the lands and erecting temporary sheds. There is a duty cast on the respondents to protect the Government land and in spite of the complaints made by the petitioners by way of representations dated 21.07.2014, 22.09.2014 and 24.11.2014, no action has been taken to protect the Government land. Considering the limited grievance of the petitioners and considering the fact what all petitioners are seeking is an action on the respondent authorities for their inaction in protecting the Government lands, a direction can be issued to the respondents, particularly respondent Nos.

2 to 4, to verify the veracity of the allegations made by the petitioners in their representations and if found true that the land is Government land, they shall take necessary steps to protect the same. Further directed, if there are any illegal encroachments, they shall also initiate necessary proceedings in accordance with law and resume the land.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, shall stand closed. ____________________________ CHALLA KODANDA RAM, J Dated:08.04.2015.
