Mrs.Fatima Afsar Begum v. State Of Telangana
HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No. 330 of 2015 DATE: 23.01.2015 Between:
Mrs. Fatima Afsar Begum .. Petitioner And The State of Telangana .. Respondent
O R D E R:- It appears from the record that the petitioner is a devout Muslim who is interested in protecting the interests of Wakf properties as Muthawalli. Merely based on the news published in "Saakshi" Telugu Daily on 17.11.2014 to the effect that the unused Wakf land in an extent of Ac.71.35 cents/guntas in Sy.No.71/1 situated in Sahebnagar Kalan village, Hayatnagar Mandal, Ranga Reddy District is going to be resumed by the Government, the petitioner has filed the present writ petition seeking to protect the Wakf property from its alienation / resumption as the Government has no authority to sell the same.
The learned Government Pleader for Revenue appearing for respondent Nos.1, 3 and 4 has submitted that the present writ petition which is filed on mere apprehension based on a news paper statement that the alleged part of the Wakf property would be put either to sale or to alienation/resumption by the Government, cannot be entertained.
I am in agreement with the submission made by the learned Government Pleader for Revenue. In view of his submission, this writ petition is liable to be dismissed as the same is premature.
Accordingly, this writ petition is dismissed. However, the petitioner is at liberty to initiate appropriate legal proceedings as she may be advised as and when any concrete proposals are
made to alienate the Wakf land in question. No order as to costs.
As a sequel to the dismissal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
