HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.21582 of 2018 ORDER:

Heard learned counsel for the petitioner and Sri T.Rajendra Prasad, learned Counsel appearing for the respondents 5 and 6. Learned counsel for the petitioner submits that as the father of the petitioner challenged enhancement of school fees, the respondents 5 and 6 bore grudge against the petitioner and not allowing the petitioner's father to pay the fees due. He submits that now father of the petitioner is ready to pay the fees due to the 6th respondent.

On the other hand Sri T.Rajendra Prasad, learned counsel for respondents 5 and 6 basing on counter averments submits that there are complaints against the petitioner and that the petitioner had already given a letter stating that he will not create any mischief in future.

A perusal of the complaint filed along with the counter affidavit goes to show that it is given by ex-students and there is no date on the same. It appears that for the purpose of this case only, the said complaint is enclosed to the counter affidavit and that too after petitioner giving explanation.

Since the father of the petitioner is ready to pay the fees due, this Court feels it appropriate to direct the 6th respondent Management to permit the petitioner for X class after paying the necessary fee. However, the petitioner shall maintain discipline while undergoing studies in the 6th respondent school.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
