HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.892 of 2017 ORDER:

The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondent has willfully and deliberately disobeyed the order dated 04.01.2017 passed by this Court in W.P.No.387 of 2017.

A perusal of the material placed on record would show that this Court while disposing of W.P.No.387 of 2017, directed the petitioner to make an online application in Form-VIA seeking issuance of pattadar pass book and title deeds in respect of lands admeasuring Ac.1.00 gts., in Sy.No.404/ D and Ac.1.00 in Sy.No.405 situated at Ashwaraopally Village, Raghunadhapally Mandal, Warangal District, after paying necessary fee, within a period of one week from today, in which event, the same shall be considered and pass necessary orders by the concerned authority. Subsequently, the petitioner made an application on 09.01.2017. The inaction on the part of the Tahsildar, lead to filing of the present contempt case.

Today, when the matter is taken up for hearing, the Government Pleader for Revenue placed on record the Memo No.B/ 436/ 2017, dated 20.02.2017, wherein the Tahsildar rejected the application of the petitioner dated 09.01.2017.

Having regard to the fact that the Tahsildar, Jaipur, has already considered and rejected the application of the petitioner, it cannot be said that there was any willful disobedience of the order passed by this Court. At this stage, the learned counsel for the petitioner seeks liberty to challenge the said memo. Hence, the Contempt Case is closed, giving liberty to the petitioner to avail the remedies available under law, in questioning the memo dated 20.02.2017.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
