THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.14832 of 2016 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Revenue appearing for respondents.

The petitioner has questioned a notice dt.13-042016 in R.C.No.189 of 2016 of the 2nd respondent under Section 7 of the A.P. Land Encroachment Act, 1905 (for short "the Act") asking the petitioner to furnish explanation why it could not be evicted from the subject land.

3. The petitioner has submitted a reply to it on 25-042016. The petitioner apprehends that before passing final order under Section 7 of the Act, the petitioner would be disposed from the subject land.

Learned Government Pleader appearing for respondents states that 2nd respondent will consider petitioner's reply to the above show cause notice and passes an order within two (02) months from the date of receipt of a copy of this order.

In view of the said submission, the Writ Petition is

disposed of directing the 2nd respondent to consider petitioner's reply dt.25-04-2016 to the show cause notice dt.13-04-2016 within two (02) months from the date of receipt of a copy of this order and till final order is passed by 2nd respondent, the petitioner shall not be evicted from the subject property.

The Writ Petition is disposed of with the above directions. No costs.

7. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
