THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.14289 OF 2016 ORDER :

Petitioner's grievance is that petitioner had filed an objection on 19.02.20216 before the fifth respondent objecting to the grant of compensation to respondent Nos.7 to 12 in respect of the subject land, which is sought to be acquired for Polavaram Irrigation Project and that the fifth respondent is likely to ignore the objections of the petitioner and pay compensation to respondent Nos.7 to 12.

He therefore seeks stay of disbursement of compensation to respondent Nos.7 to 12.

2. Government Pleader for Land Acquisition appearing for respondent Nos.1 to 6 and 13 states that the fifth respondent will consider petitioner's objections at the time of passing of the Award and communicate his decision thereon to the petitioner.

3. In view of the said assurance given by the Government Pleader for Land Acquisition, the fifth respondent is directed to consider the objections filed by the petitioner for grant of compensation to respondent Nos.7 to 12 before passing the Award under Right to Fair Compensation and Transparency under Land Acquisition, Rehabilitation Act and Resettlement Act, 2013 (Act 30 of 2013) and he shall also communicate the said Award copy to the petitioner. Till the fifth respondent takes an appropriate decision in the matter, no compensation shall be paid to respondent Nos.7 to 12.

With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous petitions pending, if any in this writ petition, shall stand closed. No order as to costs. ____________________________________________ JUSTICE M.S. RAMACHANDRA RAO April 27th, 2016 LMV
