I.A.No. 2 of 2018 is filed under Section 320 (2) of Cr.P.C. to record compromise in C.C.No. 1822 of 2018 on the file of the Court of learned IX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, registered for the offences punishable under Sections 420, 417 and 468 of IPC.
Both parties are personally present and they are identified by their respective counsel and produced Photostat copies of Aadhaar Cards in proof of their identity. On enquiry, it is stated that the petitioner-accused paid the amount due to respondent No. 2-de facto complainant.
Since the dispute is purely personal and that amount has been paid, even if trial is permitted to go on, it would serve no purpose except a futile exercise of waste of time. Therefore, I find it is a fit case to grant leave to compound the offences referred supra.
Accordingly, I.A.No. 2 is allowed permitting both parties to compound the said offences and to record compromise. In view of the orders passed in I.A.No. 2 of 2018, this Criminal Petition is allowed quashing the proceedings in C.C.No. 1822 of 2018 on the file of the Court of learned IX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad. Pending miscellaneous petitions, if any, shall stand closed in
consequence. The Registry is directed to annex a copy of the joint memo to this order.
