THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24907 of 2019 ORDER:

In this Writ Petition, petitioner's grievance is that he was proceeding with the construction in the subject land in accordance with the sanctioned plan, but, the respondents are interfering with the same.

Learned Standing Counsel for the Greater Hyderabad Municipal Corporation appearing for the second respondent, on instructions, submits that a notice under Section 452(1) of the Greater Hyderabad Municipal Corporation Act, 1955, has been issued to the petitioner alleging that he is carrying on the construction, particularly, with regard to the setbacks, in violation of the sanctioned plan. He undertakes to furnish today a copy of such notice to the learned counsel for the petitioner. In those circumstances, the petitioner is permitted to submit his explanation to the aforesaid notice within one (1) week from today. Thereupon, the second respondent shall consider such explanation and take necessary action in accordance with law. Till such time, no demolition shall be taken up with respect to the subject property.

CKR, J W.P.No.24907 of 2019 Subject to the above, this Writ Petition is disposed of. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
