Asra Nayeem v. The State Of Telangana

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28739 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to direct respondent No.3 to conduct postmortem of the deceased dead body [by name SHAFIA KHAN aged about 20 years) forthwith, consequently direct the respondent No.3 to register a case against Respondents 4, 5 and 6 and their family members under brutal murder of the deceased SHAFIA KHAN."

Heard Sri A. Ram Mohan, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. Today, when the matter is called, written instructions, dated 11-09-2015 furnished by the Sub-Inspector of Police, SR Nagar Police Station, Hyderabad City have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is also pertinent to mention that in the present case on hand, no incident whatsoever was occurred in India. I submit that if the petitioner approaches with any cognizable complaint, this respondent after conducting preliminary enquiry into the matter, necessary steps will be taken. I humbly submit that the writ petition is not maintainable. No offence whatsoever was taken place in the limits of SR Nagar Police Station limits, regarding the death of the daughter of the petitioner herein, the question of conducting of postmortem of the deceased dead body of the daughter of the petitioner herein is not proper and fair." On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition.

In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 11-09-2015 furnished by the Sub-Inspector of Police, SR Nagar Police Station, Hyderabad City.
