HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12341 OF 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both parties, the present writ petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the first respondent in attempting to demolish the structures and forcibly dispossessing the petitioner from Jeevan Jyothi High School premises in a total extent of 1050 square yards covered by plot Nos.120-123, 136-138 in Survey Nos.328 to 332 of Kukatpally village and municipality, Balanagar Mandal, Ranga Reddy District presently known as Tulasinagar, Phase-II, Allwyn Colony, Kukatpally, as illegal and arbitrary.

On 26.04.2011, this Court, while issuing notice before admission, granted status quo to be maintained for a period of six weeks. On 15.06.2011, the order of status quo was extended for a further period of eight weeks therefrom. Subsequently, there was no extension of the interim order.

A counter affidavit came to be filed by the first respondent stating that they have interfered with the land in dispute, but, however, they have not encroached on to the land of the petitioner and have not demolished the structures of the School.

Learned counsel for the petitioner submits that in case if any action is to be initiated against the petitioner, the respondents may be directed to do the same with due process of law.

Recording the contents of the counter and without going into merits of

the case, the writ petition is disposed of directing the respondents, to follow the due process of law, in case if any encroachments are made by the petitioner. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
