ORDER : (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus directing respondent Nos.3 and 4 to produce Mr. Ghansyam, s/o. Jagadeesh (for short "the alleged detenu") before this Court and set him free. A counter affidavit is filed by the Sub-Inspector of Police, Santhapeta Police Station, SPSR Nellore District, inter alia stating that the alleged detenu is Accused No.2 in Crime No.106/2018 for the offence punishable under Sections 381 and 411 IPC of Santhapeta Police Station, and he was arrested on 27.06.2018 at 19.00 hours near Central Prison, Nellore, after explaining him the grounds of his arrest. After complying with all the formalities, the alleged detenu was produced before the Judicial Magistrate of First Class, Special Mobile Court, SPSR Nellore District, on 28.06.

2018 and that on being questioned, the alleged detenu has not complained of either illegal detention or ill-treatment at the hands of the police. It is further stated that the Jurisdictional Magistrate has passed a judicial order remanding the alleged detenu to judicial custody, in pursuance of which the alleged detenu was lodged at Central Prison, SPSR Nellore District, on the same day i.e., on 28.06.2018.

No reply affidavit is filed by the petitioner controverting the above averments.

In the light of the above subsequent events, the cause in the writ petition does not survive for adjudication and the writ petition is accordingly dismissed as infructuous.
