THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.37455 of 2015 ORDER :

In this Writ Petition, petitioner assails proceedings dt.13.10.2015 of the 3rd respondent demanding a sum of Rs.8,53,409/- from the petitioner.

2. Petitioner contends that he had been provided a service connection by the respondents with M.F. 200; in 2012, since the meter provided to the petitioner was found to be defective by respondents, it was replaced by another meter with higher capacity of M.F. 400 on 20.06.2012, without informing the same to the petitioner; but the bills issued every month to the petitioner indicated the old M.F. 200 only instead of higher M.F.400, and the petitioner was paying as per the said bills.

Petitioner contends that suddenly the impugned notice has been issued by the 3rd respondent demanding the above amount indicating that the meter had the capacity of M.F.400 and the bills raised were only for M.F.200. He contends that it is illegal and arbitrary, and the action of the respondents in disconnecting petitioner's service connection cannot be sustained. Petitioner claims to have submitted representation dt.13.11.2015 to the 2nd respondent in this regard seeking restoration of service connection.

4. Sri R.Vinod Reddy, Standing Counsel for the respondents states that the 2nd respondent will consider the petitioner's representation dt.13.11.2015 within two

(02) weeks from the date of receipt of a copy of this order.

5. In this view of the matter, the Writ Petition is disposed of directing the 2nd respondent to dispose of the petitioner's representation dt.13.11.2015 within a period of two (02) weeks from the date of receipt of a copy of this order. The

respondents are directed to restore service connection to the petitioner subject to the petitioner paying 1/3rd of the demanded amount within two (02) weeks from the date of receipt of a copy of this order and such payment shall be subject to the order, which the 2nd respondent may pass on the petitioner's representation dt.13.11.2015. There shall be no order as to costs.

6. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
