HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 25049 OF 2001 ORDER: (per the Hon'ble Sri Justice S.V. Bhatt) Heard Smt. M. Indrani, learned counsel for the petitioner. None appears for the respondent.

The petitioner prays for a certiorari to quash the demand notice dated 15-11-2001 issued by the respondent.

The learned counsel appearing for petitioner at the time of hearing has placed on record the order dated 16-09-2014 in Writ Petition No. 27055 of 2001 passed by this Court in similar circumstances. The order reads thus:

"This is an old matter of the year 2001. By this writ petition, the petitioner challenged the demand notice issued by the respondent on 15.11.2001. By this notice, a sum of Rs.1,17,880/- has been demanded on account of House Tax.

While entertaining the writ petition, this Court was pleased to grant interim suspension on 3.1.2002. Since then the interim suspension is in operation. No counter affidavit has been filed to challenge the same nor any attempt has been made by the respondent to get the aforesaid interim order vacated. Under the circumstances, we think that justice would be sub-served if the following order is passed.

The Executive Officer, Gram Panchayat, Kanuru is directed to consider the petitioner's representation dated 16.6.2001 after giving personal hearing to the petitioner and by passing a speaking order. The entire exercise shall be completed within a period of six weeks from the date of communication of this order.

The writ petition is accordingly disposed of. Pending miscellaneous applications, if any, shall

also stand closed. No order as to costs."

The present writ petition is disposed of in the terms as indicated above.

Miscellaneous petitions, if any, also stand disposed of. No costs.
