M/S. Indus Towers Limited v. Duddupalem Gram Panchayath,

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7118 OF 2011 ORDER:

The case of the petitioner is that it has erected cell tower for providing infrastructural facility to cell operators after obtaining permission on 07.02.2011 from the District Panchayat Officer, Visakhapatnam. But, the respondent authorities are interfering with function of the cellular tower erected by the petitioner without issuing any notice. Aggrieved by the same, present writ petition is filed.

Though, this Court granted interim direction on 18.03.2011, no counter is filed till today.

Heard learned counsel for the petitioner.

In view of the assertions in the affidavit and in the absence of counter affidavit, the writ petition is disposed of with a direction that the respondent shall not interfere with functioning of the cell tower erected by the petitioner in Sy.No.29/6, Duddupalem Gram Panchayath, Chodavaram Mandal, Visakhapatnam District, without following due process of law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition shall stand closed.
