THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE MS JUSTICE J.UMA DEVI Writ Appeal No.1061 of 2017 JUDGMENT: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the Learned Single Judge in W.P.No.18586 of 2017 dated 09.06.2017. The appellant-writ petitioner seeks a mandamus to declare the action of the respondents in issuing house site pattas to the landless poor in Veeravallipalem, Inavailli Mandal, East Godavari District, though the said land was not fit for construction of houses due to flood affected area, as arbitrary and illegal. While it is no doubt true that the representation was submitted by the appellant-writ petitioner on 27.05.

2017 and he immediately rushed to this Court seeking a direction that his representation be disposed of, the fact remains that the petitioner's complaint is that the land assigned to them as house sites is incapable of being used as house sites. This grievance of this appellant-writ petitioner necessitates examination by the respondent officials.

We consider it appropriate, therefore, to dispose of the appeal directing the 2nd respondent to consider the representation of the appellant-writ petitioner and pass orders thereupon in accordance with law at the earliest and, in any event, not later than three months from the date of receipt of a copy of this order.

The Writ Appeal is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
