HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24006 of 2006 ORDER:

When the matter is taken up for hearing, counsel for petitioner submits that the petitioner is seeking freedom fighter pension under Swatantrata Sainik Samman Pension Scheme, 1980. It is submitted that the State Government has recommended the case of the petitioner to the Central Government, but the Central Government has returned the said recommendations, raising certain objections. Counsel for petitioner submits that the State Government thereafter has not forwarded the pension papers back to the Central Government, therefore, contends that appropriate orders be passed in the writ petition directing the State Government to forward the proposals for grant of pension to the petitioner under Swatantrata Sainik Samman Pension Scheme, 1980, and upon such proposals being received, direct the Central Government to consider the case of the petitioner and grant pension.

This Court, having considered the aforesaid submission of the counsel for petitioner, is of the considered view that this writ petition can be disposed of directing the State Government to re-submit to the Central Government, the proposals for sanction of pension to the petitioner under Swatantrata Sainik Samman Pension Scheme, within four weeks from the date of receipt of a copy of this order, and upon such proposals being received, the Central Government shall consider

the same and pass appropriate orders in accordance with law, in another Eight weeks thereafter.

With these observations, the writ petition is disposed of. No order as to costs.
