This writ petition is filed challenging the proceedings in Lr.No.ADE/OP/ CHAMPAPET/O/No.1126/19, dt.04.07.2019, wherein and whereby the petitioner was provisionally assessed to pay an amount of Rs.50,961/- and was directed to pay 50% of the said amount i.e. 25,480.50, for restoration of power supply and also directed to pay balance amount in two installments and the said assessment will be subject to determination of civil liability under Section 154 (6) of the Electricity Act (for short " the Act").

Learned counsel for the petitioner submits that no theft of energy occurred and that the respondents without following the procedure fixed the provisional amount. He also submits that already 20,000/- is paid by the petitioner to the respondents.

Since the provisional assessment has been made subject to determination of civil liability by the appropriate Court under Section 154(6) of the Act and keeping in view of the facts and circumstances of the case, this Court is of the opinion that the writ petition can be disposed of directing the respondents to restore power supply to the petitioner on payment of Rs.12,740.25 by the petitioner within a period of four weeks from the date of receipt of a copy of this order, pending

determination of further liability by the appropriate Court under Section 154 (6) of the Act. Since it is stated that the petitioner has already paid Rs.20,000/- the same may be given credit to the demanded amount, if paid.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
