HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISON PETITION No.4176 of 2017 ORDER :

Heard both sides.

So far as the merits of the order concerned, there is nothing to interfere with the impugned order of the lower Court in E.P.No.9 of 2015 of the decree in O.S.No.226 of 2013, dated 04.08.2017, passed by the learned VII Additional District and Sessions Judge, Markapur, Prakasam District, but for from consideration of the representation that the revision petitioner's application under Order IX Rule 13 C.P.C. to set aside the ex parte decree is kept pending by the same Court on original side.

Having regard to the above, there shall be suspension of the issuing of the warrant for eight weeks from the date of receipt of a copy of this order and the lower Court shall dispose the application under Order IX Rule 13 C.P.C. within four weeks. 4.

With the above directions, the civil revision petition is disposed of.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
