HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.35331 OF 2015 ORDER:
It is the case of the petitioners that the husband of the 1st petitioner and father of petitioners 2 to 5 by name Late Narendra Kumar Hemaraj died on 21-04-2015 and he has executed notarized Will and final testament on 30-03-2015 bequeathing his properties in favour of the petitioners. Late Narendra Kumar Hemaraj was having a Demat Account bearing No.089104000028404 and Trading Account with Id.No.12859962 with the respondent bank under individual status and Demat Account bearing No.089104000028778 and Trading Account with Id.No.14076847 under HUF status. Accordingly, the 1st petitioner made application to the respondent-bank with a request to transfer the shares held by late Narendrakumar Hemaraj by annexing a copy of the Will. As no action has been taken by the respondent bank, the present writ petition is filed.
Counter is filed by the respondent-bank stating that since all the family members i.e. wife, three sons and daughters of Late Narendra Kumar Hemaraj have filed the writ petition stating that they have no objection for transfer of the shares held by their father in favour of the 1st petitioner as per the will executed by the deceased account holder and asserted before this Court that there are no other legal heirs or claimants, the respondent bank is considering the request for transfer favourably and the same is now under process. In view of the same, the respondent bank is directed to take action by considering the representation of the 1st petitioner, in pursuance of the letter issued by the respondentbank on 18-09-2015, within a period of two weeks from the date of receipt of copy of order.
Accordingly, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
