THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI L.P.A.No.63 OF 2003 JUDGMENT:- (per Hon'ble Sri Justice K.C.Bhanu) This appeal, under Clause 15 of Letters Patent, is filed challenging the judgment and decree, dated 23.3.2001, in C.M.A.No.242 of 1995.
2. Learned counsel for the appellant stated that the issue involved in this case is squarely covered by the common judgment, dated 2.8.2001, in L.P.A.No.80 of 1997 and batch of this Court wherein it is held that the insurance company is liable to pay the compensation to the extent of its liability, and over and above the same, it is the Government represented by Commissioner for Special Employmentcum-Ex.Officio Secretary to Government, Finance and Planning, Government of Andhra Pradesh is liable to pay.
3. Following the said judgment, this Letters Patent Appeal is disposed of making it clear that "Enterpreneur" is not liable to pay any amount. There shall be no order as to costs.
