HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4460 of 2017 ORDER:

The petitioner claims to be absolute owner and possessor of house bearing No.31/487, Ramnagar, Dharmavaram, Anantapur District, having purchased by his father under registered sale deed document No.3016/84 dated 06.09.1984. Petitioner states that, in the process of constructing new drain, the respondent - authorities removed the compound wall and stair-case without following due process of law. The grievance of the petitioner is that the respondent - authorities are making efforts to remove further portion of house for construction of canal and, if really, the land is required, the same shall be acquired by following due process of law.

Sri Md.Saleem, learned Standing Counsel appearing for respondents, submits that the petitioner has encroached on to the drain and made constructions. He further submits that, without following due process of law, the petitioner's alleged property right will not be disturbed by the respondent - authorities.

Recording the submission made by the learned Standing Counsel for the respondents, the Writ Petition is closed. However, it is made clear that the respondent - authorities shall not interfere with the property rights of the

petitioner without following due process of law as enjoined under the A.P.Municipalities Act, 1965.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
