This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.10975 of 2019 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, pursuant to the complaint dt.03.05.2017. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for respondent No.1 - State. Perused the material on record.

Learned counsel for the petitioner contends that the present Criminal Petition has been filed by the petitioner, who is none other than the husband of respondent No.2, seeking to quash the proceedings in C.C.No.10975 of 2019 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. It is contended that a complaint has been lodged by respondent No.2 against the petitioner and other accused for the offences punishable under Sections 498-A, 420, 506 r/w. Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act. It is contended that the allegations levelled against the petitioner are all false and baseless and are made only to extract money.

As seen from the contents of the charge sheet, it is to be noted that the truth or otherwise of the allegations levelled by

GSD, J Crl.P.No.7522 of 2019 the complainant against the petitioner and other accused can only be decided during the course of trial only and this Court is not supposed to make a roving enquiry into the allegations levelled against the petitioner and other accused in the charge sheet. Therefore, I do not find any reason to interfere with the same and quash the proceedings in the above C.C.No.10975 of 2019 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

With the above observation, this Criminal Petition is disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
