This Criminal Revision Case, under Sections 397 and 401 Cr.P.C, is filed challenging the Docket Order dt.01.10.2005, which is extracted hereunder:

How this petition is maintainable when the Court has issued an attachment and Sale Order under RR Act. 3 days. Xxxxx 1-10-2005".
The present Revision Petitioner filed a petition i.e., Crl.M.P.No.8538 of 2005 before the trial Court to grant 30 days time to enable him to produce the Auto in the Court, raising several contentions, instead of proceeding under RR Act for sale. It appears from the Court, the Court had already initiated proceedings under RR Act to realize the amount. But, the Docket Order is not a final order. Since the petition is only returned to the petitioner by the trial Court stating that the petition is not maintainable, no revision is maintainable on such an Order, in view of the bar contained under Section 397(3) Cr.P.C.
Accordingly, this Criminal Revision Case is dismissed. As a sequel, miscellaneous petitions, if any, pending in this case, shall stand dismissed.
