THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13759 of 2016 ORDER:

Petitioner had applied for sanction of Patta under the Andhra Pradesh (Andhra Area) Inams (Abolition and Conversion into Ryotwari) Act, 1956 to the 2nd respondent, who is the competent authority, by way of application dt.13.07.2015 along with documents of title relating to land of an extent of Ac.2.00 guntas owned by her, but by the impugned endorsement dt.06.08.2015 the 2nd respondent rejected the petitioner's application for issuance of patta under the above Act, on the ground that the petitioner had submitted only one application and that she did not enclose the sale deeds under which she purchased the land referred to above.

2. In my considered opinion, the impugned endorsement dt.06.08.2015 is perverse. Merely because the petitioner purchased Ac.2-00 Guntas of land under two different sale deeds, one for Ac.1-00 cents and another for Ac.0-50 cents, it is not necessary that the petitioner should make two applications. That apart, the application filed by the petitioner itself states that the petitioner had produced the sale deeds under which she purchased the above land. Assuming that the said statement is not correct, the 2nd respondent could have asked the petitioner orally to produce the said sale deeds and after looking into them, he could have taken appropriate action.

3. Therefore, the Writ Petition is allowed; the impugned endorsement dt.06.08.2015 is set aside; the matter is remitted back to the 2nd respondent to consider the petitioner's application

for sanction of Patta under the above statute on the petitioner producing copies of sale deeds, under which she had purchased the above land, within a period of two (02) weeks from the date of receipt of a copy of this order; and the 2nd respondent shall then take appropriate action within a period of four (04) weeks from the date of submission of copies of sale deeds in question by the petitioner. There shall be no order as to costs.

4. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
