These Criminal Petitions are filed under Section 438 of Cr.P.C. by the petitioners/Accused seeking bail in the event of their arrest in connection with Crime No.713 of 2023 on the file of S.R.Nagar Police Station, Hyderabad, registered for the offences punishable under Sections 364-A, 342 and 323 r/w. 34 of Indian Penal Code.

Since the petitioners in both the petitions are accused in the very same crime, both the petitions are heard together and disposed off by way of this common order.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged on 20.08.2023 stating that A-1 and the de-facto complainant were friends. They had started 'Rynchops' Company in which both of them invested. For investment of A-1 of Rs.50 lakhs, an amount of Rs.1.5 crores was given. However, A-1 incurred losses in the real estate business. On 19.08.2023, A-1 invited de-facto complainant to

meet him for the reason of US client visiting them. Accordingly, A-1 and the de-facto complainant met near Inorbit Mall, Gachibowli. From there, they boarded a car and at Chilkur cross roads, these petitioners along with two other persons boarded the car who threatened the de-facto complaint to give an amount Rs.6 crores to A-1, failing which he would be killed. It is further alleged that the de-facto complainant was beaten up in the car. When the Police stopped the car at Maddur check post in Karnataka State, the de-facto complainant got down from the car and complained to the Police that he was forcibly taken. Thereafter, he returned to Hyderabad and lodged a complaint on the next day i.e., on 20.08.2023 5.

This Court by order dated 31.08.2022 granted the relief of anticipatory bail to A-1. These petitioners were subsequently identified as persons who boarded the car and threatened the de-facto complainant. In view of the allegations leveled against these petitioners are same as that of A-1, on the ground of parity, the prayer for anticipatory bail of these petitioners can be considered, subject to the following conditions:

1) The petitioners/Accused are directed to surrender before the Station House Officer, S.R.Nagar Police Station, Hyderabad, on 27.09.2023.

On such surrender, the said Station House Officer shall

release the petitioners on bail, on their executing personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused shall appear before the concerned Station House Officer at 10.00 A.M everyday till 31.10.2023 for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
